Throughout her legal career, Ms. Penny has counseled numerous licensed operators and individuals in response to U.S. Nuclear Regulatory Commission/Office of Investigations (NRC/OI) probes into intentional violation of plant procedures, inaccurate statements to the NRC, safety conscious work environment (SCWE) discrimination, security related and force on force drill misconduct, and regulatory or plant performance violations culminating in referrals to the Department of Justice or United States Attorneys Offices. These representations have taken her to many nuclear power plants throughout the United States. In addition, Ms. Penny has conducted confidential, or internal fact finding investigations for companies in response to government inquiries, NRC referred allegations, employee hotline calls, and whistleblower reports of misconduct by management or union employees.
Since 2007, Ms. Penny has provided consultant services to the U.S. Department of Energys Office of Enforcement in connection with nuclear safety, worker safety and health, and classified information security enforcement investigations.
Appointed Member, Pennsylvania Judicial Independence Commission. Member, Pennsylvania Board of Law Examiners, 1998-2004.
Ms. Penny currently serves as a Supreme Court appointed member of the Pennsylvania Commission on Judicial Independence. From 1998 through 2004, she was an appointed member of Pennsylvanias Board of Law Examiners. She is admitted to practice in all Pennsylvania Courts, the Third Circuit of Appeals, and the U.S. Supreme Court.
