- Based on the declared State of Emergency for the Gulf Coast in the wake of Hurricane Ike, the Texas Department of Insurance issued a Commissioner's Bulletin this week (See Commissioner's Bulletin #B-0059-08),that extends filing deadlines and waives penalties for out-of-network health-related claims. This bulletin follows the disaster declarations made by the State of Texas and the federal government for the Texas counties of: Angelina, Austin, Brazoria, Brazos, Chambers, Cherokee, Fort Bend, Galveston, Gregg, Grimes, Hardin, Harris, Houston, Jasper, Jefferson, Liberty, Madison, Matagorda, Montgomery, Nacogdoches, Newton, Orange, Polk, Rusk, Sabine, San Augustine, San Jacinto, Trinity, Tyler, Walker, Waller, Washington and Wharton.
The declaration requires health insurance companies and health maintenance organizations to cover necessary emergency and non-emergency health and dental services that are obtained out-of-network for persons affected by the declaration. Contractual requirements will be suspended with regard to pre-authorization, referrals, notification of hospital admissions, and medical necessity reviews for specified health care or dental services through the duration of the Governor’s disaster proclamation.
