• EEOC Issues Guidance on the Application of Age Discrimination Rules to Retiree Health Coverage

  • On July 14, 2003, the Equal Employment Opportunity Commission ("EEOC") issued a proposed amendment to the regulations implementing the Age Discrimination in Employment Act of 1967 ("ADEA"), which exempts from ADEA's prohibitions the practice of altering, reducing or eliminating retiree health coverage upon the retiree's attainment of Medicare eligibility. This proposed rule is in direct response to the Third Circuit Court of Appeal's August 2000 decision in Erie County Retirees Ass'n v. County of Erie, 220 F. 3d 193.
