  • On August 3, 2004, the Centers for Medicare and Medicaid Services ("CMS") published proposed regulations addressing certain Medicare proposals contained in the "Medicare Prescription Drug, Improvement, and Modernization Act of 2003" (P.L. 108-173) (the "MMA"), signed into law on December 8, 2003. Among other things, the MMA expanded Medicare prescription drug coverage under a new Medicare Part D program ("Part D") and created additional managed care options for Medicare beneficiaries through the implementation of the Medicare Advantage program ("MA"), which has replaced the previous Medicare+Choice program.
