  • In a rare capitulation, the Internal Revenue Service (IRS) recently announced that FICA taxes should not have been paid by teaching hospitals and their residents and interns for periods prior to April 1, 2005. This means that a teaching hospital may be entitled to millions of dollars in employer-portion FICA refunds from the IRS, and its current and former residents entitled to a refund of the portion of FICA taxes that they paid.
