  • The recent Allina settlement highlights the government's position that there is an affirmative duty of health care providers to report known overpayments. It indicates that providers should investigate additional potential overpayments and ensure that they have safeguards to ensure proper billing going forward. Along these lines, Medicare has published a proposed rule that would require providers to self-report overpayments within 60 days of identification of the overpayment.
