U.S. Citizenship and Immigration Services (USCIS) announced today that as of yesterday, January 26, 2011, it had received a sufficient number of H-1B petitions to reach the statutory cap for Fiscal Year (FY) 2011. The agency will accept no further standard or advanced degree cap-subject cases for FY 2011.
H-1B cap-subject petitions that were received on January 26, 2011 will be entered into a computer lottery, and selected cases will be processed to completion. Cases not selected will be rejected and returned. Any cap-subject case received today, January 27, and thereafter, will be rejected and returned, at least until the FY 2012 H-1B cap season starts on April 1. USCIS also clarified that a properly filed case will be considered received when USCIS receives the petition, rather than the date it is postmarked.
