Employers should prepare for increased compliance reviews and worksite inspections in 2014. The Canadian government has published new regulations that expand the enforcement powers of the compliance wing of the country’s labor authority - Employment and Social Development Canada (ESDC), formerly called Service Canada.
The ESDC has yet to release updated criteria for compliance reviews and inspections. At the moment, compliance reviews and worksite inspections are being executed under existing government guidelines.
What This Means for Employers
Employers should continue to ensure that they maintain accurate records regarding terms of employment; that remuneration levels comply with salary rules and are consistent with representations made in prior applications; that foreign workers are employed in the occupation cited in prior applications; and that foreign employees are working at the location listed on their work permit.
