• H-1B Processing Update: Receipting Near Completed; Adjudications Underway

  • USCIS announced on May 4, 2015 that initial data entry for all H-1B cap cases selected in the FY 2016 lotteries is now complete and adjudications are underway. Receipt notices for both premium and non-premium cases continue to be issued, but are beginning to taper off and are likely to cease in the coming days. The agency is expected to return unselected cases over the course of the next month and will make an announcement once all petitions have been returned.

    What’s Next: RFEs and Decisions

    By May 12, employers should see adjudicative action on all of their premium filings ¿ either an approval, an RFE or, in some cases, a denial. The adjudication of non-premium cases began on May 4, 2015, and some employers have already received approvals or RFEs on these cases. Non-premium adjudications are expected to continue through mid-August, by which time employers should see an approval or RFE in all of their receipted cases.

    What This Means for Employers
