  • CIS announced that as of April 8, 2008, a sufficient number of H-1B petitions subject to the 2009 Fiscal Year numerical limitation ("cap") had been submitted, and no new H-1B petitions subject to the cap will be accepted. The numerical limitation ("cap") on new H-1Bs for FY2009 is approximately 65,000. Similar to last year, CIS will adopt a "random lottery" process to allocate the H-1B cap numbers. Unlike last year, the issuance of a Receipt Notice by USCIS will indicate that USCIS has "receipted in" the case AND that the petition has been "accepted" under the H-1B cap. As we receive additional information from USCIS regarding the cap count, we will provide updates.
