Counseling and Advice

Our labor and employment attorneys advise management on the best practices for handling day-to-day personnel issues and compliance with federal, state and local laws. We draft employee handbooks and policies, as well as employment, non-compete and confidentiality agreements. We advise clients regarding the negotiation of collective bargaining agreements and assist them with grievance proceedings. For companies considering mergers and acquisitions, we conduct due diligence related to labor and employment issues. And our labor and employment attorneys work closely with our ERISA and employee benefits team.


Despite a client’s best efforts at prevention, employee lawsuits are inevitable. Our lawyers represent clients in individual and class action employment-related litigation in administrative, state and federal forums. Our litigation experience includes matters relating to:

  • All forms of discrimination and harassment
  • Whistleblower and retaliation claims under the Sarbanes-Oxley Act and other federal and state statutes
  • Disability and leave issues under the Americans with Disabilities Act, Family and Medical Leave Act and USERRA
  • Wage and hour issues under the Fair Labor Standards Act and state statutes
  • Protection of trade secrets and confidential and proprietary information
  • Defamation/intentional infliction of emotional distress
  • OSHA and workplace safety issues

We have secured defense verdicts in numerous trials and arbitrations, and have obtained summary judgments and dismissals for employers at the pre-trial stage of many lawsuits.  In matters where our clients are interested in alternative dispute resolution, Liskow & Lewis attorneys are well prepared to negotiate favorable settlements. 

Early intervention by our labor and employment attorneys in litigation matters, or at the administrative level, permits our clients to make informed decisions related to employment disputes. Our clients insured under employment practice liability policies often instruct their insurers to appoint our firm as defense counsel. This gives our clients the security of being represented in litigation by seasoned employment lawyers with a deep understanding of their specific business needs.

Government Investigations

Our experience before administrative agencies enables us to walk clients through a government investigation efficiently and productively. We have handled numerous matters involving the Equal Employment Opportunity Commission (EEOC) and state commissions, Office of Federal Contract Compliance Programs (OFCCP), state and federal Departments of Labor (DOL), the National Labor Relations Board (NLRB), and the Occupational Safety and Health Administration (OSHA).

Disaster Recovery Issues

In the aftermath of major natural disasters such as Hurricanes Katrina and Rita, our attorneys can assist employers facing unique challenges. These include locating employees, establishing effective means of communication, planning for the reopening of the business, assessing staffing needs, considering layoffs or plant closings, and addressing benefits questions.  Liskow & Lewis’ attorneys can inform business owners and managers about available hurricane relief programs, as well as ensuring that federal and state laws, wage and hour statutes, and unemployment statutes are properly considered when confronting these issues.

We commit to investing the time and resources necessary to hire, mentor and retain lawyers of diverse backgrounds, recognizing that diversity efforts must not end with recruitment.  Members of our firm actively participate in several national and local organizations that promote diversity within our profession, including the Louis A. Martinet Legal Society, National Bar Association, Minority Corporate Counsel Association and the Louisiana Bar Association’s Minority Involvement and Diversity Sections.

Our recruiting committee actively seeks students and attorneys with diverse backgrounds and experiences.  Through our firm’s mentoring program and other diversity initiatives, we strive to assist our associates in developing skills that will help them grow professionally and rise to the highest levels of not only our firm but within our communities.

Liskow & Lewis supports an active diversity committee, co-chaired by New Orleans shareholder Todd Wallace.  The committee consists of shareholders and associates from each of our offices and devotes its time and energy to the professional growth of minority attorneys as well as the growth of a diverse client base.  Dana Douglas also currently serves as the firm's Minority Recruitment and Retention Partner so as to coordinate our ongoing efforts to seek out the best minority attorneys for possible positions within our firm, while insuring that those lawyers receive the appropriate professional mentoring and training as they develop their practice. 

However, today’s diversity initiatives are only the beginning at Liskow & Lewis.  We continue to explore new and more effective methods to recruit, hire and retain talented attorneys and staff members with diverse backgrounds.  These continuing efforts are an integral part of our mission to provide superior client services.


Liskow & Lewis regularly recruits top graduates from leading law schools in Louisiana, Texas and across the country, including those students who share our commitment to continuing the development of a diverse firm culture.

To accomplish this goal, we regularly participate in the LSBA Minority Job Fair and the Tulane Diversity Clerkship Program for summer associate positions.  The firm annually sponsors Southern University’s Law Review Induction Ceremony and Awards Banquet.  In 2007, Liskow & Lewis is proud to once again sponsor the student breakfast for the Sunbelt Minority Job Fair in Dallas, Texas, one of the nation’s largest minority-oriented recruitment programs.

Early year, Liskow & Lewis hosts receptions in its various offices for minority law students from local law schools.  Working through the local BLSA, HLSA and APLSA student associations, these receptions provide unique opportunities for our attorneys to demonstrate our commitment to minority law students and diversity within the profession at the earliest phase of their careers.

Professional Development

While identifying and recruiting successful minority students and lawyers is critical to our diversity efforts, Liskow & Lewis believes that mentoring and assisting our young attorneys in their professional development is equally important.

Our Associate Training Committee meets monthly with associates to tackle various topics ranging from practical training to client development.  The firm’s Mentoring Program provides each young lawyer with additional guidance on how to meet the demands of their profession. Realizing that women attorneys and minorities may face unique challenges during their careers, the Diversity Committee and the Women’s Practice Development Group ensures that those lawyers receive the advice and assistance necessary to meet their professional development needs as well as those of their clients.

Through its attendance at such events as the annual American Conference Institute’s Law Firm Diversity Forum and the DRI’s Diversity for Success Seminar, Liskow & Lewis continues its commitment to identify and learn new methods of assisting our young lawyers.


Liskow & Lewis’ commitment to retaining and fostering the development of a talented and diverse group of lawyers is reflected in its promotion of minority and women attorneys to leadership positions within the firm as well as its active involvement in organizations who share this firm’s commitment to diversity.  For example:

  • Marilyn Maloney recently served as the Managing Partner of the Houston office and as a member of the firm’s Board of Directors.
  • Cheryl Kornick heads the firm’s Technology Committee and is a former member of the governing Board of Directors.
  • Ms. Kornick and Marguerite Adams serve on the firm’s Paralegal Committee.
  • Randye Snyder chairs the firm’s Pension Committee.
  • Todd Wallace chairs the firm’s Recruiting and Hiring Committee.
  • Jana Grauberger chairs the Recruiting and Hiring Committee for the Houston office.
  • In fact, 10 minority and women lawyers currently serve on our Recruiting and Hiring Committee.
  • Dena Olivier serves on the Associate Training Committee having recently chaired this group.
  • Liskow & Lewis is a signatory to the Houston Bar Gender Initiative Commitment Statement.
  • Todd Wallace and Dana Douglas are currently working with members of the Louisiana Supreme Court and other leaders in the legal profession to develop a similar minority initiative program in the New Orleans area.
  • Mr. Jackson serves as the Director of the Ruby Bridges Foundation and has served on several national diversity-related groups, including the United States Vice President’s Inter-Agency Commission on Diversity. Mr. Jackson also is the recipient of the Attorney General’s Award for Equal Employment Opportunity.
  • Ms. Maloney is president of the Louisiana State Law Institute. She has provided pro bono counsel for organizations including the Ulster Project, New Orleans and the Economics Institute of Loyola Law School of New Orleans.
  • Michael Rubenstein serves on the Anti-Defamation League’s Regional Advisory Board.
  • Ms. Grauberger serves on the Board of Directors of the Women's Energy Network of Houston.  She works as the organization's Special Events and Networking Director.
  • Ms. Douglas will serve as the 2006-2007 Chair of the New Orleans Bar Association’s Young Lawyers Section, whose primary goals include fundraising to provide legal assistance to the poor and underprivileged in the New Orleans area and increasing minority participation within the local bar association.  Ms. Douglas is also a former chair of the Minority Involvement Section of the Louisiana State Bar Association.
  • Mr. Wallace currently serves on the Executive Board of the Young Lawyer’s Section.
  • In 2005, Mr. Jackson and Ms. Douglas were featured in the New Orleans City Business 10th Anniversary Edition of Success Guide, an annual recognition of local minorities who are making a difference in our community.
  • Kelly Scalise serves as the Chair of the Federal Bar Association’s Younger Lawyers Division and is a member of the FBA’s governing Board of Directors.
  • Leta Seletzky was recently appointed to the Houston Bar Association's Minority Opportunities in the Legal Profession, Administration of Justice, and Law & the Media committees.
