Our Public-Private Partnerships (P3) Group is adept at addressing the regulatory, contractual, transactional, financial and political issues that accompany P3s.

Peckar & Abramson’s familiarity with all aspects of P3 projects enables our group to help clients solve challenges to successfully build these complex and risky projects. Our P3 Group's legal, political and business experience, and relationships with government officials, financial institutions, concessionaires, contractors, architects and engineers, provides insights few other firms can provide.

Our group will efficiently help you avoid risks that can threaten the profitability of P3s. We regularly counsel clients on complex P3 projects, including civil infrastructure initiatives such as bridges, tunnels, highways, pipelines and railways, and social infrastructure projects such as schools and prisons.

We offer a multidisciplinary approach with extensive domestic and international experience in P3 projects. Our attorneys are skilled at helping clients navigate political risk, while addressing the interests of all stakeholders. We can help with:

  • All aspects of construction and public contract law, thanks to having a diverse and experienced group of construction lawyers in key markets around the country, and relations with leading firms around the world.
  • All phases of a P3, from concept and permitting, to bidding and project capture, and then through construction, operation and maintenance.
  • Government relations: In these projects, navigating the political landscape can be crucial. We help clients develop the support necessary at all levels of local, state and federal government, from conception through operation.
  • The creation and negotiation of contracts with government agencies and authorities, with concessionaires, and with design-builders.

Notable engagements

Presently representing the construction joint venture in connection with the Port Authority's Goethals Bridge Replacement Project, including review and evaluation of various draft versions of Project Agreement issued by the Authority.

Represented a real estate developer bidding on the Department of Defense Military Housing Privatization Initiative. Supported project capture efforts by strategizing all legal and government affairs endeavors and oversaw legal work necessary to close more than 18 deals valued at over $3 billion.

Represented a design firm teamed to bid for the Tappan Zee Bridge replacement project.

Advised a joint venture bidding for the design, engineering, construction and financing of the proposed High Desert Corridor toll road (north of Los Angeles).

Represented a consortium interested in bidding for the proposed Yonkers school P3 program.

Advised two large construction companies on how to engage with private equity for teaming on P3 projects.

Advised executives and legislative officials exploring P3 legislation in Pennsylvania, New Jersey, New York, California, and Colorado.

Represented private equity sponsor in joining with national parking operator to pursue P3 projects with cities and universities.

Represented a corporation in its P3 with NASA to film explorations in outer space.

Represented a construction joint venture pursuing a TxDOT P3 agreement to develop the SH-121 Toll Project in Denton and Collin Counties in Texas. This involved the review and evaluation of various drafts of the Comprehensive Development Agreement issued by TxDOT.

Represented a construction joint venture, in negotiating a Consortium Agreement to pursue a High Speed Rail Link between Tampa and Orlando, Florida for which the Florida High Speed Rail Authority solicited proposals to design, build, operate, maintain and finance.

Represented a construction joint venture, in pursuing the Ohio River Bridges East End Crossing P3 Project, linking Indiana and Kentucky over the Ohio River, including negotiations with the sponsor.

Represented various CJVs in connection with the review and evaluation of other RFP documents for P3 infrastructure projects in the U.S., including bridge, toll road, high speed rail and lightrail projects.

Represented general contractor in relation to the I-595 P3 Corridor Roadway Improvements Project.
