We provide a full range of services for the establishment and continued operation of insurance based businesses. We counsel underwriters, brokers, intermediaries, agents, claims adjusters and corporate risk managers.
We are selected by insurance companies to represent insureds in every conceivable claim dispute. We are also appointed as counsel at the request of our corporate clients. We have counseled clients with respect to many types of insurance coverage issues including matters involving advertising injury, defamation, environmental claims, D&O coverage, trademark and copyright infringement, premises liability products liability and professional liability.
Corporate Insurance & Reinsurance
We can address legal issues of mergers and acquisitions, demutualizations, and recapitalizations, including mutual insurance holding company act issues. We also provide guidance on regulatory compliance and legislative developments. We have established domestic and offshore mutual and stock insurance and reinsurance companies, managing general agencies and captive management companies.
We have extensive experience in the litigation of coverage issues. We have litigated and provided advice on coverage disputes involving, among others, trademark and infringement, environmental claims, employment and employee benefit claims, financial bonds and claims, product liability claims, property damage claims and professional errors and omissions exposure.
We represent clients on a wide array of issues in administrative and judicial proceedings. We assist clients in obtaining original certificates of authority and regulatory approval of acquisitions of licensed entities. We have also been involved in insurer insolvency proceedings, counseling our clients on regulatory issues and insolvency proceedings.
We also have substantial litigation experience. We have been representing the interests of insurers and their insureds since our founding in 1935. We are able to handle any litigation, big or small, simple or complex, at all times recognizing the identity and interests of our clients or clients.
We handle bad faith litigation on behalf of our insurer clients and, when appropriate, pursue claims of bad faith against other insurers. Our experience from “both sides” of the transaction has been invaluable in our defense of bad faith claims against our insurer clients.
