  • The Health Insurance Portability and Accountability Act of 1996 ("HIPAA") requires the issuance of a "Notice of Privacy Practices" to covered individuals. While the insurer is typically responsible for the provision of this Notice in the context of an insured health plan, the sponsoring employer will be responsible to issue the Notice in the case of a self-insured health plan (or an insured health plan if the employer creates or receives protected health information -- "PHI").
