- “It is helpful to have a decision on this issue because there had been some conflicting decisions by the courts in Washington, mostly federal courts, on whether a regulatory violation alone would support claims under the IFCA for treble damages and attorneys’ fees,” said Goldberg Segalla attorney Louis H. Kozloff in a Law360 piece.
Lou, a partner in the firm’s Global Insurance Services Practice Group in Philadelphia, weighed in on the impact of a recent decision in Washington Supreme Court that limits insurance policyholders’ ability to sue insurers over regulatory violations under the state’s Insurance Fair Conduct Act (IFCA).
“The highest court in Washington addressed the issue fairly conclusively,” he noted.
