- ITC Institutes Investigation (337-TA-870) Regarding Certain Electronic Bark Control Collars

On February 19, 2013, the U.S. International Trade Commission issued a press release announcing their vote to institute an investigation of Certain Electronic Bark Control Collars (Inv. No. 337-TA-870).
The investigation is based on a January 14, 2013 complaint filed by Radio Systems Corporation of Knoxville, Tennessee (“RSC”) alleging violation of Section 337 in the importation into the U.S. and sale of certain electronic bark control collars that infringe one or more claims of U.S. Patent No. 5,927,233. RSC also filed a motion for preliminary relief with the complaint. See our January 15, 2013 post for more details on RSC’s complaint and motion.
According to the Notice of Investigation, the Commission has identified Sunbeam Products, Inc. d/b/a Jarden Consumer Solutions of Boca Raton, Florida as the sole respondent in this investigation. In addition, regarding RSC’s motion for temporary relief, the Notice of Investigation provides that the Commission has provisionally accepted and referred such motion to the presiding ALJ for investigation.
Lastly, Chief ALJ Charles E. Bullock issued a notice indicating that E. James Gildea will be the presiding Administrative Law Judge in this investigation.
