  • Yesterday, the Oregon Court of Appeals issued an opinion ruling that the state Land Use Board of Appeals (LUBA) improperly found that a Clatsop County Commissioner displayed disqualifying bias when he voted in favor of withdrawing the County’s approval of a land use permit for a pipeline to serve the proposed Oregon LNG terminal. The opinion remands the case back to LUBA to consider the merits of the County’s withdrawal and subsequent denial of the land use permit.
