This notice specifies the duties of the newly established Anti-Monopoly Bureau under the Ministry of Commerce (MOFCOM). Its scope of work includes: conducting legal investigations related to the Operators’ Concentration Anti-Monopoly Act; providing advice to local enterprises in responding to anti-monopoly prosecutions abroad; and conducting bilateral negotiations related to competitive policy.
Two previous circulars announced the establishment of bureaus in the State Administration of Industry and Commerce (SAIC) and the National Development and Reform Commission (NRDC). The bureau within SAIC is responsible for investigating violations of anti-monopoly agreements and gives SAIC administrative authority to counter restrictive competition, while the NDRC bureau is responsible for addressing monopolistic pricing. The new notices provide more specificity on the powers of the anti-monopoly authorities in China.
