Important Litigation Involvement
•Defense of multi-million dollar property damage claims and bad faith allegations against insurer in Florida, Mississippi, Alabama, and Louisiana following Hurricane Katrina
•Defense of dram-shop claims against Gulf Coast Casino
•Successfully defended multi-million dollar allegations against corporation claiming theft of a competitor's trade secrets and corporate raiding of employees, and then obtaining sizeable settlement award to conclude counterclaims based on misconduct of plaintiff and its attorneys during underlying suit
•Successfully pursued contract litigation against the buyer of a commercial building seeking judgment that an amendment to the contract waiving the buyers' rights to a return of the escrow deposit was enforceable, despite the fact that the amendment had not been signed by all sellers before the buyers attempted its revocation. Judgment granted by the Mississippi Court of Appeals at 43 So.3d 1138 (buyers' requests for writ of certiorari from Supreme Court denied at 49 So.3d 106)
•Compelled arbitration of lawsuit filed in federal district court by former president of $100 million subsidiary of a publicly traded company; and after the close of discovery involving production of thousands of documents and multiple depositions, obtained summary judgment on all of plaintiff's remaining claims; and thereafter defeated plaintiff's motion to vacate the arbitration award before the district court (2012 WL 718876)
•Obtained judgment of dismissal from Mississippi Supreme Court in favor of successor lender, who had purchased mortgage loan from bankrupt lender, from borrower's claims of fraud on basis that borrower's claims had already been disallowed in the bankruptcy of the prior lender and were thus barred. (17 So. 3d 1087)
•Successfully defended lender for claims made by victim of identity theft, obtaining summary judgment on claims for malicious prosecution and emotional distress and only $503 verdict for negligence, which was affirmed on appeal by the Fifth Circuit Court of Appeals (212 Fed. Appx. 334)
•Obtained dismissal of wrongful death claim involving juvenile killed in collision on ATV with tractor trailer, after intervening in estate action, removing administrator who filed suit, and negotiating dismissal and release with successor administrator for mere cost of her expenses
•Obtained summary judgment from circuit court in favor of insurance company from claims by previous beneficiary under life insurance policy that the beneficiary designation had been fraudulently changed following the insured's death
