Important Litigation Involvement

•At trial court level, led Forman Watkins' efforts resulting in dismissal of Ingersoll-Rand Company as a compressor manufacturer from more than fifty silica cases in Mississippi on the basis that it had no duty to warn of dangers inherent in a product (silica) that it did not manufacture or supply (e.g., McGowen v. Dependable Abrasives, No. 2002-288-CV9 (Circuit Court Jones County, Mississippi, 2nd Judicial District, May 2, 2005)). Led the team which won a similar motion for Ingersoll-Rand Company in the Texas Silica MDL (Mullens v. American Optical, MDL No. 2005-07992 (Harris County Texas, 295th Judicial District, Feb. 5, 2007)).
•Led Forman Watkins' team in achieving dismissals in eleven cases for General Electric Company on federal preemption grounds (e.g., Sellers vs. American Standard, Inc., No. 06-CV-128(W) (Circuit Court, Lauderdale County, Mississippi, Jan. 10, 2007)).
•Led Forman Watkins' litigation/appellate teams in cases which have been instrumental in changing Mississippi's mass tort landscape, including the seminal decision of the Mississippi Supreme Court in Forman Watkins' appeal in Harold's Auto Parts, Inc. v. Mangialardi, 889 So. 2d 493 (Miss. 2004), in which the court held that the prevailing practice of mass joinder of plaintiffs in Mississippi was improper, that single-plaintiff actions would be required, and that all present and future mass tort complaints would have to meet fact-specific pleading standards.
•Led Forman Watkins' efforts in Amchem Products, Inc. v. Rogers, 912 So. 2d 853 (Miss. 2005), in which the Mississippi Supreme Court held that out-of-state plaintiffs with no viable connection to Mississippi in terms of worksites or claims against a resident defendant must be dismissed - thus paving the way for the dismissal of tens of thousands of plaintiffs from Mississippi court dockets. In addition, in Forman Watkins' appeal in Gorman-Rupp Co. v. Hall, 908 So. 2d 749 (Miss. 2005), the court made summary judgment a viable option for many asbestos defendants in Mississippi by explicitly adopting the Lohrmann standard and requiring that asbestos plaintiffs come forward with sufficient and concrete evidence of frequency, regularity and proximity of exposure to respirable asbestos.
•Successfully defended the constitutionality of the Mangialardi decision to dismiss out-of-state plaintiffs who had no connection to Mississippi (Albert v. Allied Glove Corp., 944 So. 2d 1 (Miss. 2006) and Coleman vs. A-Bex Corp., 943 So. 2d 697 (Miss. 2006)).
