  • The Age Discrimination in Employment Act (ADEA) forbids discriminatory preference for the young over the old. In General Dynamics Land Systems, Inc. v. Cline, the U. S. Supreme Court rejected age discrimination claims of workers in their 40s who will not receive retiree health benefits given to their older colleagues. After reviewing the ADEA's text, structure, purpose, history, and relationship to other statutes, the Court concluded that the ADEA was not intended to stop an employer from favoring an older employee over a younger one.
