  • The United States Department of Labor recently issued long-awaited guidance and templates for the Notice of Exchange mandated by the Affordable Care Act (“ACA”), and also set a deadline of October 1, 2013 for this Notice to be sent out. Under the ACA, the Notice of Exchange, officially titled “New Health Insurance Marketplace Coverage Options and Your Health Coverage,” is designed to alert employees about the health benefit exchangesthat are slated, as part of the ACA, to begin offering health insurance coverage in 2014. The Notice of Exchange also requires employers to identify whether they offer health insurance to their employees and if so, to disclose information about the quality of the insurance (in particular, whether it meets the minimum value and affordability standards mandated by the ACA.) The Notice also includes an optional page that employers can use to provide additional information about such health insurance.
