  • The United States Court of Appeals for the Third Circuit (which covers New Jersey, Pennsylvania, Delaware and the U.S. Virgin Islands) recently upheld an employer's right to access an employee's post-transmission e-mail communications from the employer's central file server without the employee's permission. The ruling should serve as a reminder to employers and their counsel of the importance of having a clear policy regarding permitted (and un-permitted) uses of company electronic equipment.
