  • With myriad of new laws, ordinances, and varying court decisions in federal, state, and municipal arenas coming into the picture literally each year, it is no wonder that the Equal Employment Opportunity Committee of the American Bar Association has identified same-sex harassment based on sexual orientation and gender nonconformity, as well as discrimination against trans-gendered employees, as some of the hottest areas in employment litigation. This article explores the frontiers of numerous controversial subjects, not the least of which is the definition of the very term, "sex," which are under increasing scrutiny as a result of significant recent developments and resulting uncertainties.
