  • On August 23, 2004, the regulations released by the U.S. Department of Labor ("DOL") revising the white collar exemptions to the overtime pay requirements of the Fair Labor Standards Act ("FLSA") went into effect. The new regulations vary considerably from what the DOL proposed in March 2003 and change significantly the long-standing system for classifying employees as exempt or non-exempt for purposes of overtime pay under the FLSA.
