  • On May 23, 2007, the Equal Employment Opportunity Commission ("EEOC") issued "Enforcement Guidance: Unlawful Disparate Treatment of Workers with Caregiving Responsibilities" ("Enforcement Guidance").1 The Enforcement Guidance is not binding legal authority. However, all EEOC offices will adhere to it when investigating and administering discrimination charges, and courts may consider it as persuasive authority when adjudicating discrimination lawsuits.
