  • On February 24, 2004, in General Dynamics Land Systems, Inc. v. Cline, the United States Supreme Court concluded that employers may use age as a valid criterion on which to award more lucrative benefits to older workers without violating the Age Discrimination in Employment Act ("ADEA"). In doing this, the Supreme Court held that the ADEA does not grant younger workers the ability to file reverse-age discrimination lawsuits.
