  • The long-awaited updated regulations to the Fair Labor Standards Act ("FLSA") "white collar" exemptions have finally arrived. They will take effect on August 23, 2004, assuming that: (1) the AFL-CIO forgoes or fails in threatened litigation; (2) Sen. Harkin (D- Iowa) ceases or fails in his effort to prohibit the reclassification of any currently non-exempt employee to exempt; and (3) opponents are unable to use the Congressional Review Act to nix the changed regulations entirely. The U.S. Senate approved Harkin's amendment to an unrelated expert tax bill (S.1637) today, but it may be removed during conference committee with members of the U.S. House of Representatives.
