• Proposed Regulations Modifying The Fair Labor Standards Act's Overtime Rules

  • The U.S. Department of Labor ("the DOL") recently issued proposed regulations which, if adopted, will significantly change employers' overtime obligations pursuant to the Fair Labor Standards Act ("FLSA"). The primary goals of the proposed regulations are to: (a) increase the minimum salary for the "salary level test" and annual salary to be deemed a "highly compensated employee;" (b) propose a mechanism to automalically increase that salary level on n annual basis; and (c) obtain feedback regarding whether the DOL should revise "the duties test" and whether non-discretionary bonuses should be included to determine whether the "salary level test" is met.
