  • The Fifth Circuit Court of Appeals has ruled that the National Labor Relations Board ("NLRB") ruling in D.R. Horton, Inc. v. NLRB, erred in holding that homebuilder D.R. Horton had violated the National Labor Relations Act ("NLRA") by requiring that its employees sign an arbitration agreement that prohibited them from pursuing claims in a collective or class action.
