  • Colorado employers are required to complete a written "affirmation of legal work status" for each new employee. Employers are also required to keep photocopies of the documents that employees provide when completing the Form I-9. Previously, employers could create their own version of the written affirmation, as long as it met the state's legal requirements.

    However, for employees hired on or after October 1, 2012, employers are now required to use a form published by the Colorado Department of Labor and Employment (CDLE), a copy of which can be found by going to: http://www.colorado.gov/cdle/evr. New state regulations also clarify that employers must complete the affirmation form within 20 days of the date of hire.

    The CDLE is conducting compliance audits on numerous Colorado employers each week. Now is definitely a good time to make sure that you are using the required form and that your employee records are in good order.
