• Little Publicized Amendment to Fair Labor Standards Act Requires Employers to Provide Reasonable Breaks to Nursing Mothers

  • When President Obama signed the health care reform legislation into law, there was a provision that got lost in the fanfare over the major changes to health care. The Patient Protection and Affordable Care Act of 2010 includes an amendment to Section 7 of the Fair Labor Standards Act (FLSA) which requires that employers provide a “reasonable break time” to permit an employee to express breast milk for her nursing child. The Department of Labor has been given authority to issue regulations, but hasn’t done so yet; however, they just issued a Fact Sheet which covers the basics as set forth below.
