  • Reversing its previous position, the Maryland Division of Labor and Industry, Department of Labor, Licensing and Regulation ("DLLR") has published guidance stating that accrued but unused vacation leave is a "wage" under the Maryland Wage Payment and Collection Law ("MWPCL") and must be paid to employees upon termination even though the employer has a written policy providing for forfeiture of unused vacation leave.
