• NLRB Decides To Review "Recognition Bar" In Cases Involving Neutrality and Card Check Procedures

  • Recently, the National Labor Relations Board ("NLRB") issued a notice and invitation to file amicus briefs in two consolidated cases that will determine, at least in some circumstances, the validity of the "recognition bar doctrine." Dana Corp., 341 NLRB No. 150 (June 7, 2004). The recognition bar doctrine bars decertification petitions and petitions by rival unions for a reasonable period of time following an employer's voluntary recognition of a union based on a demonstration that it has the support of a majority of the employees in the unit.
