  • The U. S. Department of Labor's ("DOL") widely debated revisions to the Fair Labor Standards Act ("FLSA") overtime regulations went into effect on August 23, 2004. The new rules revise the salary and duties tests used to determine whether an employee is entitled to overtime pay under federal law. Although disputed by organized labor and other groups, according to the DOL, the new regulations will strengthen overtime rights for 6.7 million American workers, including 1.3 million low-wage workers who received no overtime under the old rules.
