  • I Introduction: The genuine use of a trademark in EU law and Greek law With a view to reforming trademark law in Greece, Law 2239/1994 was abolished and replaced by Law 4072/2012 . The new act on trademarks contains broad changes and introduces new procedures and arrangements in the Greek landscape. Among the new arrangements, Article 143 refers to the process of proof of use of the mark by the opponent during the opposition procedure. The provisions thereof reproduce those of Regulation 40/94/EC on the Community trademark (Article 43), as codified by Regulation 207/2009/EC (Article 42) .
