  • Situation:Several current and former employees send a demand letter to the local manager of national employer and file EEOC Charges, all of which allege Companywide discrimination and various torts. Only the local manager receives the notice of the Charges. Neither the demand letter nor the Charges are brought to the attention of legal counsel for more than two weeks. Company has more than twelve email and document servers and over 60,000 employees. Computer backup tapes are generally recycled every six weeks.
