  • Believe it or not, when a California Court of Appeal recently awarded a single plaintiff $4.133 million on her disability discrimination claim, it had actually significantly reduced the amount awarded by the jury during trial. In Roby v. McKesson HBOC, et al., Nos. C047617, C048799 (3rd App. Dist. Dec. 26, 2006), the plaintiff was a former employee who had worked for the company for over twenty-five years with a stellar record before becoming disabled when she suffered from extreme panic attacks. A little while after she developed the panic disorder, she received a new supervisor who was less than sympathetic to her condition.
