U.S. lawyers, bracing themselves for litigation under the amendments to the federal procedural rules governing electronic discovery, have become increasingly familiar with terms previously considered the sole province of IT departments. Amended rules 16, 26, 33, 34, 37, and 45 clarify application of the Federal Rules of Civil Procedure in the modern electronic information age, an age in which companies spend billions of dollars per year on electronic information, company networks send and receive millions of emails every month, and electronic information speeds across international borders by way of email and linked computer networks.
