  • In United Steel, Paper & Forestry, Rubber Manufacturing Energy, Allied Industrial & Service Workers International Union v. Shell Oil Co., No. 08-56672, 2008 WL 5143873 (9th Cir. Dec. 9, 2008), the Ninth Circuit reversed the district court and held that removal in a multi-defendant action under CAFA does not require the consent of all defendants.
