  • On February 18, 2005, President Bush signed into law the Class Action Fairness Act of 2005 (109 P.L. 2, 119 Stat. 4 (2005)), changing the practice of state law litigation through class actions. Although most employment class actions are brought under federal law and are already subject to federal court jurisdiction, a growing number of state law employment and wage-and-hour class actions are being filed around the country, either on their own or in conjunction with federal law cases. The Class Action Fairness Act will impact how those state law cases are litigated.
