• Apollo Nuclear Contamination: Litigation Moves Forward After Ruling

  • On Thursday, Feb. 27, 2014, Federal Judge David Cercone ruled that primary expert testimony may proceed in the upcoming trial for the lawsuit alleging harmful radioactive emissions in Western Pennsylvania's Parks Township-Apollo area. Motley Rice represents people in the lawsuit who reported serious illnesses and even death, alleged to have been caused by exposure to radiation contamination from two former nuclear enriching facilities, Babcock & Wilcox Power Generation Group and The Atlantic Richfield Company.

    “This public liability action was filed on behalf of residents living and working in close proximity to the Apollo nuclear processing plant who developed various types of cancers known to be associated with radiation exposure,” said Motley Rice member and lead counsel, Anne McGinness Kearse. “This ruling allows us to continue our fight to seek accountability for the release of radioactive-enriched uranium into the surrounding  community, which was in violation of federal law.”
