  • On July 10, 2014, the U.S. Court of Appeals for the Federal Circuit (“Federal Circuit”) reversed the U.S. District Court for the Eastern District of Texas’ (“District Court”) denial of a motion to stay litigation. Salesforce.com and other defendants (“Salesforce”) filed a joint motion to stay VirtualAgility’s (“Plaintiff”) patent infringement lawsuit. Defendants argued that staying the litigation pending the post-grant review of the validity of Plaintiff’s patent was justified under the American Invents Act (“AIA”).
