• Moldovan Merger Guide Under the New Competition Law

  • Mergers in Moldova are regulated by the Competition Law No. 183, adopted on 11 July 2012 and in force since 14 September 2012 (the “Law”). Following the adoption of the Law, the previous Law on Protection of Competition No. 1103-XIV dated 30 June 2000 and the Law on Limiting the Monopoly Activity and on Development of Competition No. 906-XII dated 29 January 1992 were abolished. No Competition Law Regulations have been adopted yet; however, the drafts of the following Regulations have been published for public consultations: - Draft Regulation of economic concentrations - Draft Regulation on the evaluation of anti-competitive vertical Agreements (vertical agreements that do not fall within the scope of Article 5 paragraph (1) of the Competition Law) and on the applicability of the exceptions provided by Article 6 of the Competition Law. Since these Regulations are yet to be adopted, this Merger Guide will elaborate solely on the content of the Law.
