Derek B. Barba, a partner in the firm’s General Liability Practice Group, focuses his practice on all matters relating to general liability litigation, including cases involving claims of personal injury from automobile accidents, slips and falls, negligent security, wrongful death, medical malpractice, nursing home and assisted living facility malpractice, insurance coverage issues, third party administration malpractice, fraud and special investigation claims, and negligent hiring and retention. He represents both individuals and corporations, and as a fluent Spanish speaker, his background includes numerous cases representing Spanish-speaking clients. A highly experienced trial attorney, Derek has tried over 40 jury trials across Florida.

Derek has extensive experience in all kinds of liability cases and has a track record of developing innovative defenses to defend against plaintiffs’ junk science claims. This includes developing a strategic and replicable approach for defending cases that involve minimally invasive surgical procedures or percutaneous discectomies and disc decompressions by establishing defense strategies to attack the science as well as the billing under “Letters of Protection” as excessive and unreasonable.

A Miami native, Derek earned a dual bachelor’s in English literature and international and comparative studies from the University of Miami before going on to pursue his juris doctor at St. Thomas University School of Law.

Representative Matters: Obtained a defense verdict in a case in which the 20-year-old plaintiff claimed injury to her shoulder from a motor vehicle accident and underwent arthroscopic surgery with no prior history of shoulder trauma. The jury found that no injury was caused by the motor vehicle accident.; Obtained a defense verdict in a case in which the plaintiff claimed cervical and lumbar herniated discs following a roll-over motor vehicle accident. The jury found no injury related to the accident.; Obtained a defense verdict with a finding of no liability in a case in which the plaintiff drove a truck into an overhang at a high rate of speed and claimed that the defendant failed to warn of overhang.; Defended a slip and fall case in which the plaintiff had a fracture of his ankle requiring open reduction internal fixation surgery as well as a second surgery to remove the hardware, and obtained a verdict of 50 percent comparative liability on the plaintiff and reduced the medical expenses whereby the total verdict was $8,000.
