Biography

Originally from Baldwin County, Alabama, Robby is a graduate of Daphne High School, where he was co-valedictorian of his graduating class. He later graduated from the University of Alabama and The University of Alabama School of Law, where he was inducted into Phi Beta Kappa. Prior to joining the firm, Robby clerked for a Mobile, Alabama-based law firm and the Hon. William H. Steele, Chief Judge for the United States District Court for the Southern District of Alabama.


Since joining the firm, Robby has developed a diverse, regional practice focused on the defense of products liability, professional liability and personal injury litigation. He regularly appears in state and federal courts throughout Alabama, Mississippi, Georgia and Tennessee as lead counsel for clients ranging from product manufacturers, to long-term care facilities to individual medical and non-medical professionals being sued in errors and omissions litigation. Robby also regularly defends catastrophic personal injury and wrongful death cases of all types, including commercial transportation, hunting accident, and health and fitness related claims, and he has experience in environmental, land use, commercial, class action, and business tort litigation.

Summary judgment in favor of medical device manufacturer in first pelvic mesh lawsuit filed in Alabama;


Summary judgment in favor of medical device manufacturer in multiple implantable prostheses cases on FDCA preemption grounds;


Summary judgment in favor of Hoyer lift manufacturer in wrongful death litigation arising out of patient falling from lift during transport;


Summary judgment in favor of power wheelchair manufacturer in products liability claim alleging limb loss due to defective product design and manufacture;


Successful defense of home medical equipment manufacturer in multiple products liability claims;


Summary judgment in favor of heavy truck manufacturer in ICC bar/underride litigation;


Successful defense of anesthesiologist in case of paraplegia following epidural steroid injection;


Summary judgment in favor of favor of OB/GYN in lawsuit alleging that infant developed seizure disorder due to allegedly contra-indicated medications prescribed to mother during pregnancy;


Successful defense of long-term residential care provider for the intellectually disabled in numerous wrongful death and serious personal injury lawsuits throughout Alabama inlcuding multiple summary judgments on various grounds;


Summary judgment in favor of regional mental health board in Tarasoff / wrongful death litigation;


Summary judgment in favor of Head Start provider and multiple individual officers and directors thereof in Title IX and § 1983 litigation arising out of alleged sexual abuse of six students by member of school’s faculty;


Defense verdict at trial in favor of YWCA in case alleging tort of outrage;


Defense verdict in favor of professional services company in case alleging carbon monoxide poisoning of elderly couple;


Defense verdict in favor of HVAC contractor in trial alleging negligent installation of geothermal HVAC resulting in extensive water damage to multi-million dollar home;


Complete exoneration of Mississippi Public Improvement District in bond and other litigation generally arising out the financial crisis of 2007 including summary judgment in federal court litigation challenging PID Board’s failure to approve approximately $2 million in disbursements to project general manager and successful defense of that summary judgment in front of the 5th Circuit Court of Appeals as lead appellate counsel;


Complete exoneration of licensed professional counselor in licensure action brought by Alabama Board of Examiners in Counseling arising out of counselor's alleged sexual abuse of client;


Complete exoneration of facial plastic surgeon in licensure action brought by Alabama Board of Medical Examiners following pre-trial settlement of medical malpractice claim;


Robby has been widely recognized for his success by his clients and peers. He maintains an AV Preeminent Peer Review Rating through Martindale Hubbell.
