Biography

Robert R. Hempstead is Chair of the Real Estate Finance Practice Group. Mr. Hempstead focuses on the area of commercial real estate finance, including loan workouts and distressed loan purchases, with a strong background in the origination of commercial mortgage loans which are to be securitized in the capital markets. His practice covers a broad spectrum of deal structures and features, such as multi-asset portfolios, multiple classes of debt, mezzanine and other subordinate debt features, including second mortgages and preferred equity, participation and co-lending arrangements among multiple lenders, credit tenant lease transactions, tenancy-in-common ownership, both syndicated and sponsor-owned and operated, 1031 exchanges and loans secured by leasehold estates, as well as a variety of collateral property types, both fee and leasehold, across the United States, including retail, office, hotel, multifamily and industrial. With a very comprehensive understanding of the requirements of the capital markets and rating agencies with respect to CMBS lending, Mr. Hempstead has advised CMBS lenders in connection with the establishment of their commercial mortgage loan conduit programs and continues to provide advice and counsel with respect to their on-going operations. Mr. Hempstead also advises lenders and loan servicers in connection with structuring and negotiating commercial real estate loan work-outs and modifications. Prior to joining the Firm, he was associated with Weil, Gotshal & Manges in their New York City office, where his practice area focused on the representation of private and institutional lenders.
