All too often, a trucker is over his hours-of-service (HOS) as evidenced on his electronic logging device (ELD). A collision results and the Department of Transportation (DOT) performs a post collision Level I inspection of the driver and the equipment. Frequently, infractions of the Federal Motor Carriers Safety Regulations (FMCSRs) demonstrate Out-of-Service (OOS) violations that negatively impact the truck company's Safety Measurement Scores (SMS). Patterns of poor safety behavior can be proven by frequent penalties in one or more of the Behavioral Analysis Safety Improvement Categories (BASICs). Enforcement officials utilize the data from these violations and place them into an algorithm to identify the truly bad truck companies. This federal enforcement program is called Compliance, Safety and Accountability (CSA), if the company and/or driver is not compliant with the regulations, then they are not safe, and must be held accountable. Very non-compliant truck companies are singled out and must undergo a company-wide Compliance Review (CR). Unfortunately, the federal government can only do so much to prevent wrecks caused by forced dispatch, fatigued driving, poor vehicle maintenance, unsafe driving behavior, poor driver fitness, driving while drugged, drunk, drowsy, or distracted.
