- Temporary Injunction on New Personal Injury Protection Law Granted; Florida Office Of Insurance Regulation to Appeal by March 22

Today, March 20, 2013, the Second Circuit Court of Leon County granted a motion for temporary injunction in litigation brought late in 2012 by a group of Florida massage therapists and others in the health care community who are challenging a new law (HB 119) with respect to Personal Injury Protection insurance billing.
The motion was granted only on the portion of the complaint alleging that the new law denies people the right of access to the courts to seek redress for their injuries.
The Florida Office of Insurance Regulation ("OIR") has advised all insurers writing automobile coverage in Florida that it will file an appeal, possibly by this Friday, March 22.
According to the OIR, the appeal should act as a stay of the injunction order until the 1st DCA rules otherwise.
