Biography

Michael T. Liburdi, Chair of the Phoenix Litigation Practice, counsels clients on a wide variety of state and federal court matters and governmental law and policy issues. He advises his clients on complex commercial litigation, political and constitutional litigation, administrative and regulatory proceedings, campaign finance compliance and elections procedures, and matters related to antitrust and unfair competition. Michael’s litigation experience also includes class action and appeals.

Michael formerly served as General Counsel to Arizona Governor Douglas A. Ducey. In that role, he managed litigation involving the Governor’s Office and executive agencies, assisted in the drafting of executive orders, and advised Governor Ducey on judicial appointments. Michael also represented the Governor’s Office in gaming compact negotiations with Arizona’s tribal nations.

Michael serves as an adjunct professor of law at the Sandra Day O’Connor College of Law at Arizona State University.

Experience: Representative Matters: Counseled Arizona's governor and executive staff to a successful settlement of school finance litigation that resulted in $3.5 billion in additional funding for public schools over a 10-year period.; Worked with members of Arizona's Congressional delegation to obtain consent of Congress for Arizona State Land Trust distributions benefiting K-12 public schools and other beneficiaries, Public Law No. 115-141, Div. S, Title IV, 401.; Drafted executive orders ordering a rulemaking moratorium on state agencies, boards, and commissions and terminating private contract lobbyists representing the State of Arizona.; Served as legal counsel to the 2014 Arizona Gubernatorial Transition Committee.; Defended the Arizona Legislature in litigation concerning Arizona's campaign finance contribution limits, Citizens Clean Elections Comm'n v. Brain, 322 P.3d 139 (Ariz. 2013).; Served as plaintiff's litigation counsel in redistricting trial to a three-judge panel challenging unequal population of legislative districts, Harris v. Ariz. Independent Redistricting Comm'n, 993 F. Supp. 2d 1042 (D. Ariz. 2013).; Served on defense group in Sherman Act class action litigation against Arizona hospital systems alleging price fixing for temporary nurses.
